View Full Version : Producer & Licence FUBAR!
Just got pulled by the [edit] police [edit]!! Calling them a farm animal on a public forum makes you sound like a prat 3 points for running a red light ... but I am sure it was amber (at a speed of 20mph!). Anyway £60 and 3 points.
Fair enough.
My problem is I now have a producer.
MOT, Insurance, V5 all that is fine... but my licence has my old address on from 2 years ago!
(Its the old paper style one, and I just confirmed with DVLA that the photocard one not a legal requirement yet). DVLA said to take the incorrect address licence to the Police stn ... but can they penalise me more for this???
Any ideas, please?

Lucky that they gave me a verbal warning only for the private number plate (did'nt want to add insult to injury) ... though the other copper was tyring his hardest to be scary!

I've done that before, they just made me fill in my current details on the back and they kept it and sent it to DVLA for them to update, although that was pre-photocard so I'm not sure what they'll do with yours as you'll have to do the photo thing etc.
Guess you could always try telling the station that you can't find your licence, they can check on PNC and see that you've got a current one, then send it off and get it updated. May work.
should I phone the cops and ask them, annonomously?

Just did... and the copper said if all documentation is not produced within 7 days, a warrant will be issued for my arrest!!!! :eek:

Bloody hell, they don't often sit there. Probably bored, they love hunting for Beemers in Bracknell these days it seems...:mad: They're cheeky tossers too, I see at least 1 and normally 2 cars a day jump the reds on that roundabout, I even had someone lock up their brakes behind me once cos I had the audacity to stop just as the light went amber-red. Still, it doesn't make it right, just annoying when they single one person out from the 100+ a day who must do it.
To return to the subject though, as per usual the front desk coppers do love their movies... Strictly speaking, the various police forces actually stipulate that 'action will be explained to the individual upon failure to produce their licence', which is about as ambiguous as it could possibly get, but basically implies to 'do it or else', as is the wont of our lovely government-inspired police force. Cos it's so bloody hard for them to check on the computer and see that all of your documents are up to date (which they would have checked when they PNC'd your car before pulling you over anyway). In practice, however, as with a lot of matters that these bully boys like to throw their weight around on, the law is slightly more explanatory and is also a lot more reasonable.
Part 7 of the Road Traffic Act 1988, Section 164, Subsection 8 (no, I'm not taking the piss before someone asks) states that you won't be charged and convicted if you produce your licence in person (driving licence always has to be produced in person) as soon as you can, or that it was not reasonable for you to produce it before the day that they charged you for it's non-production. Which, if you've lost your licence and are waiting for a new one from DVLA, is the case. Basically, if you can prove that you've reported your licence lost to DVLA, then CPS won't even bother with the paperwork cos it'll get thrown out of court every time if the Popo do decide to try and take it that far.
However, litigation aside, it may just be a whole lot easier to give them the sad puppy eyes and your incorrect licence, apologise for the oversight of not updating the address, show them all the other documents which prove where you live, and offer to fill it out and have them post it for you to make sure it goes. If nothing else, it's a more honest approach to the problem.
Yeah... think I'll do that... give licence as is, along with updated forms from the post office with new address details on.

Just take your incorrectly addressed license with some already filled out forms and say you only realised the address was wrong when you looked at it.
Surely a better approach than pretending you've lost it.

Yeah maybe, it does suggest that you already knew. Just take it in as is and see what happens. They're not gonna do you for an incorrect address on your license if you insurance and everything else is correct. Think of the paperwork involved, its just not worth it.

UPDATE
It was all fine guys. Don't know what I was so worried about!
The Police officer clerk at the station put a not eon the form that I was known at the old address. The licence then goes to their 'central points' dept, and DVLA don't even see it.
I put my current address on the back just in case, but the officer was not bothered by that. (We just had a chat about where I was born, cos she came from the same town).
The licence will be sent back to my parents house, and upon receipt I will change the address and make it all proper.
